What your notice must include
Per 17 U.S.C. §512(c)(3)(A), a complying notification of claimed infringement must include all of the following:
- Identification of the copyrighted work claimed to have been infringed. If multiple works on a single AsideMe page are covered, a representative list of the works.
- Identification of the material that is claimed to be infringing on AsideMe, with information reasonably sufficient to let us locate it — at minimum the URL or path of the page/document on AsideMe.
- Your contact information — full legal name, mailing address, telephone number, and email.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. Typing your full legal name in the signature field of the form below counts as an electronic signature.
Incomplete notices may be rejected. A knowingly false claim of infringement may result in liability for damages under §512(f).
Submit a takedown notice
Counter-notification
If material you posted on AsideMe was removed because of a DMCA notice and you believe the removal was in error or you have authorization to use the material, you may send a counter-notification to dmca@asideme.app. Per §512(g)(3), it must include:
- Your physical or electronic signature
- Identification of the material that was removed and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number, plus a statement consenting to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the U.S., the district where AsideMe is located)
- A statement that you will accept service of process from the person who provided the original notification or their agent
If we receive a valid counter-notification, we will forward it to the original complainant and may restore the removed material in 10–14 business days unless the complainant files a court action.
Repeat infringer policy
It is AsideMe's policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. Multiple validated DMCA notices against the same account are grounds for termination at our discretion.
What happens after you submit
- You receive a confirmation email with a tracking ID within 1 hour.
- Our team reviews the notice within 24 hours.
- If the notice is facially valid, we remove or disable access to the material, notify the user who posted it, and let you know via email.
- If the user submits a valid counter-notification, we forward it to you.
- You may need to file a court action within 10 business days to keep the material disabled.
Misuse
Knowingly submitting a false or fraudulent DMCA notice may expose you to liability under §512(f). The same applies to false counter-notifications. Don't use this process to harass other users or to take down content you don't actually have rights over.
